Terms & Conditions

  1. 1. Information on how to enter and prizes form part of the Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. The Promoter reserves the right to amend these Terms and Conditions at any stage without prior notice.
  2. 2. Entry is only open to Australian residents. Employees (and their immediate families) of the Promoter and any associated companies, agencies and promoters of the 5 Star Breakfast Experience promotion are not eligible to enter.
  3. 3. To enter, entrants must visit www.5starbreakfast.com.au during the promotional period, input all requested information and upload a photo of a five star experience.
  4. 4. The Promoter reserves the right, at anytime during or after the closing date of the promotion, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Terms and Conditions. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  5. 5. Incomplete or indecipherable entries will be deemed invalid.
  6. 6. Multiple entries permitted, subject to the following: (a) each entry must be substantially unique; (b) each entry must be an original creation of the entrant; and (c) each entry must be submitted separately and in accordance with entry requirements.
  7. 7. The Sanitarium 5 Star Breakfast Experience Promotion commences on 15th November 2007 at 9:00am AEDST and closes on 31st January 2008 at 5.00pm AEDST. This is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged based on originality and creative merit. The winners will be selected at the Promoter's premises on 4th February 2008 at 10:00am AEST. Winners will be notified by email and their names will be published on the Sanitarium 5 Star Breakfast website [www.5starbreakfast.com.au] on the 6th February 2008. The judges' decision in relation to any aspect of the competition is final and binding on each person who enters and no correspondence will be entered into.
  8. 8. The best entry as determined by the judges will win a 5 Star Breakfast experience. The experience will consist of the winners choice of one experience from a range of experiences, details of which are set out below. Winner will be responsible for any additional or ancillary cost not specified as part of the chosen experience, including all costs associated with travel to and from the experience chosen.
  9. 9. If any chosen prize (or part of any chosen prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
  10. 10. Total prize pool value is up to $1000. Prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
  11. 11. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.
  12. 12. All entries submitted become the property of the Promoter. Entries will not be returned to any entrant. As a condition of entering into this promotion, each entrant agrees to license all of their rights, title and interest (including copyright) in and to their entry to the Promoter. Each entrant warrants to the Promoter that each entry submitted is an original artistic work of the entrant that does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
  13. 13. The Promoter reserves the right to invalidate any entry that it considers, in its absolut descretion, to be offensive, harmful, difamitory or otherwise inappropriate for display on the promotional website, for any reason.
  14. 14. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
  15. 15. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (g) use of and participation in the prize.
  16. 16. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.

Prize packages will vary from location to location both in terms of inclusions and the suppliers responsible for running the experience on the day. Accommodation (other than that specified), spending money, additional taxes, insurance, transfers, meals (other than those specified), beverages, items of a personal nature, in-room charges, travel to a prize location, costs associated with prize attendance and all other ancillary costs (unless specified) are the responsibility of the winners. Prizes are subject to availability and must be taken before 30.9.08. Prizes cannot be taken during Australian school holidays, public holidays or peak periods. Prizes are subject to the standard terms and conditions of individual prize and service providers. In the event that a winner does not take a prize by the time specified by the Promoter, the prize will be forfeited by the winner and cash will not be awarded in lieu of the prize.
